(一)、国家*审批权限
根据国家*《关于加强建设项目环境影响评价分级审批的通知》(环发〔2004〕164号)文件及其附件规定，以下项目环境影响评价文件须报国家*审批：
农林水利：国际河流和跨省(区、市)河流上的水库项目;需*协调的国际河流、涉及跨省(区、市)水资源配置调整的项目;跨流域调水工程;库容1000万立方米及以上水库项目;总投资10亿元及以上的其他水利工程;在山区、丘陵区、风沙区实施的总投资5亿元及以上造林、林业综合开发项目。
煤炭：国家规划矿区内的煤炭开发项目;年产50万吨及以上煤炭液化项目。
电力：在主要河流上建设的和总装机容量25万千瓦及以上水电站项目;抽水蓄能电站;火电站;燃煤热电站;核电站;330千伏及以上电压等级的电网工程。

省环境保护行政主管部门依据国家有关规定，对上报*环境保护行政主管部门审批的环境影响评价文件提出初步审核意见，并负责下列建设项目环境影响报告书、环境影响报告表或者环境影响登记表的审批和项目竣工环境保护验收。
1、省人民*或省投资主管部门审批、核准或备案的建设项目(包括省人民*批准的区域性开发项目)。
2、跨省辖市行政区域或可能造成跨省辖市行政区域环境影响的建设项目。
3、在省沿江开发总体规划和城市总体规划确定的区域范围外新建、改建或者扩建的石油化工等项目。
4、生产、销售、使用放射性同位素和射线装置的项目，以及伴生放射性矿开发利用项目。
5、*环境保护行政主管部门审批范围以外、豁免水*(按《电磁辐射防护规定》〔GB8702-88〕执行)以上的电磁辐射项目。

(四)、县环保局审批权限
县环境保护行政主管部门负责对国家、省、市审批权限以外的建设项目进行环境影响评价等审批和项目竣工环境保护验收。
二、建设项目环境保护审批的六条原则
1.建设项目符合国家和地方的有关法规、政策，包括不使用国家限制或禁止使用的物资(如受控的消耗臭氧层物质、石棉等)，不属于工艺设备落后、浪费资源及无有效污染防治措施的生产经营项目(如“十五小”、“新五小”等)。
2.建设项目的选址、布局符合城乡建设总体规划、环境保护规划或有关功能区的要求。
3.建设项目建成投入运行后，排放的污染物或能量(废水、废气、固体废物、放射性废物、电磁波、噪声等)符合国家和地方规定的标准，且不造成建设项目所在地及其影响所及地区环境功能类别下降或不可接受的生态环境破坏。
4.建设项目建成投入运行后，排放的污染物不超过建设项目所在地人民*或环境保护行政主管部门核定的总量控制指标;总量控制指标需在区域内*衡的，其*衡方案应切实可行，且得到项目所在地方人民*或环境保护行政主管部门的批准。
5.建设项目采用的生产工艺和技术装备先进，能耗、物耗、水耗符合国家有关要求，并尽可能实行清洁生产。
6.建设项目的环境保护问题较复杂、所处位置较敏感或可能引起环境污染纠纷的，建设项目环境保护审批前须征得建设项目所在地大多数居民或有关单位的同意。
三、报批建设项目环境影响评价文件的附件
(一)、报批《建设项目环境影响报告表》须提交的材料
1、《建设项目可行性研究报告》或《建设项目申请报告》1份;
2、建设项目所在的区域位置图，包括水系图，标明河水流向、周围环境敏感目标和居住人群;
3、具有一定环境风险或污染较重、难以治理的建设项目，提交初步的`环境影响分析或治理方案;
4、《建设项目环境影响登记表》6份及其软盘;
5、投资主管部门出具的备案通知书或初步核准意见;
6、涉及在河流新建或扩建排污口的，须有水行政主管部门同意新、扩建排污口的证明材料。
(二)、报批《建设项目环境影响报告表》须提交的材料：
1、建设项目所在地环境保护行政主管部门和行业主管部门(必要时含水行政主管部门或海洋行政主管部门)签署预审意见的《环境影响报告表》6份及其软盘;
2、《建设项目排放污染物指标申请表》及其软盘;
3、《建设项目环境保护审批登记表》及其软盘;
4、附有环境影响专项分析或专项评价的应附环境保护咨询中介机构的技术评估意见;
5、《建设项目可行性研究报告》或《建设项目申请报告》1份;
6、投资主管部门现具的备案通知书或初步核准意见;
7、涉及在河流新建或扩建排污口的，须有水行政主管部门同意新、扩建排污口的证明材料。
(三)、报批《环境影响报告书》须提交的材料
1、建设单位请求对建设项目《环境影响报告书》进行审批的报告;
2、建设项目《环境影响报告书》1份及其软盘;
3、建设项目所在地环境保护行政主管部门及行业主管部门(必要时含水行政主管部门或海洋行政主管部门)的预审(或审核)意见;
4、《建设项目排放污染物指标申请表》2份及其软盘;
5、《建设项目环境保护审批登记表》1份及其软盘;
6、环境保护咨询中介机构的技术评估意见;
7、《建设项目可行性研究报告》或《建设项目申请报告》1份;
8、投资主管部门出具的备案通知书或初步核准意见;
9、涉及在河流新建或扩建排污口的，须有水行政主管部门同意新、扩建排污口的证明材料。
四、审批时限
法定期限：报告书60天、报告表30天、登记表15天;
承诺期限：报告书、报告表、登记表分别为10、5、1个工作日，须踏堪现场的，为踏堪现场后期。
一、审批权限
(一)、国家*审批权限
根据国家*《关于加强建设项目环境影响评价分级审批的通知》(环发〔2004〕164号)文件及其附件规定，以下项目环境影响评价文件须报国家*审批：

省辖市环境保护行政主管部门对上报省环境保护行政主管部门审批的环境影响评价文件提出初步审核意见，并负责下列建设项目环境影响报告书、环境影响报告表或者环境影响登记表的审批和项目竣工环境保护验收。
1、省辖市人民*或省辖市投资主管部门审批、核准或备案的建设项目。
2、国家和省环境保护行政主管部门审批权限以外的化工、染料、农药、印染、酿造、制浆造纸、电石、铁合金、焦炭、电镀、垃圾焚烧等建设项目。
3、跨县(市、区)行政区域或可能造成跨县(市、区)行政区域环境影响的建设项目。
(四)、县环保局审批权限
县环境保护行政主管部门负责对国家、省、市审批权限以外的建设项目进行环境影响评价等审批和项目竣工环境保护验收。
二、建设项目环境保护审批的六条原则
1.建设项目符合国家和地方的有关法规、政策，包括不使用国家限制或禁止使用的物资(如受控的消耗臭氧层物质、石棉等)，不属于工艺设备落后、浪费资源及无有效污染防治措施的生产经营项目(如“十五小”、“新五小”等)。
2.建设项目的选址、布局符合城乡建设总体规划、环境保护规划或有关功能区的要求。
3.建设项目建成投入运行后，排放的污染物或能量(废水、废气、固体废物、放射性废物、电磁波、噪声等)符合国家和地方规定的标准，且不造成建设项目所在地及其影响所及地区环境功能类别下降或不可接受的生态环境破坏。
4.建设项目建成投入运行后，排放的污染物不超过建设项目所在地人民*或环境保护行政主管部门核定的总量控制指标;总量控制指标需在区域内*衡的，其*衡方案应切实可行，且得到项目所在地方人民*或环境保护行政主管部门的批准。
5.建设项目采用的生产工艺和技术装备先进，能耗、物耗、水耗符合国家有关要求，并尽可能实行清洁生产。
6.建设项目的环境保护问题较复杂、所处位置较敏感或可能引起环境污染纠纷的，建设项目环境保护审批前须征得建设项目所在地大多数居民或有关单位的同意。
三、报批建设项目环境影响评价文件的附件
(一)、报批《建设项目环境影响报告表》须提交的材料
1、《建设项目可行性研究报告》或《建设项目申请报告》1份;
2、建设项目所在的区域位置图，包括水系图，标明河水流向、周围环境敏感目标和居住人群;
3、具有一定环境风险或污染较重、难以治理的建设项目，提交初步的`环境影响分析或治理方案;
4、《建设项目环境影响登记表》6份及其软盘;
5、投资主管部门出具的备案通知书或初步核准意见;
6、涉及在河流新建或扩建排污口的，须有水行政主管部门同意新、扩建排污口的证明材料。
(二)、报批《建设项目环境影响报告表》须提交的材料：
1、建设项目所在地环境保护行政主管部门和行业主管部门(必要时含水行政主管部门或海洋行政主管部门)签署预审意见的《环境影响报告表》6份及其软盘;
2、《建设项目排放污染物指标申请表》及其软盘;
3、《建设项目环境保护审批登记表》及其软盘;
4、附有环境影响专项分析或专项评价的应附环境保护咨询中介机构的技术评估意见;
5、《建设项目可行性研究报告》或《建设项目申请报告》1份;
6、投资主管部门现具的备案通知书或初步核准意见;
7、涉及在河流新建或扩建排污口的，须有水行政主管部门同意新、扩建排污口的证明材料。
(三)、报批《环境影响报告书》须提交的材料
1、建设单位请求对建设项目《环境影响报告书》进行审批的报告;
2、建设项目《环境影响报告书》1份及其软盘;
3、建设项目所在地环境保护行政主管部门及行业主管部门(必要时含水行政主管部门或海洋行政主管部门)的预审(或审核)意见;
4、《建设项目排放污染物指标申请表》2份及其软盘;
5、《建设项目环境保护审批登记表》1份及其软盘;
6、环境保护咨询中介机构的技术评估意见;
7、《建设项目可行性研究报告》或《建设项目申请报告》1份;
8、投资主管部门出具的备案通知书或初步核准意见;
9、涉及在河流新建或扩建排污口的，须有水行政主管部门同意新、扩建排污口的证明材料。
四、审批时限
法定期限：报告书60天、报告表30天、登记表15天;
承诺期限：报告书、报告表、登记表分别为10、5、1个工作日，须踏堪现场的，为踏堪现场后期。
